Part A – IMC Employee Store Terms of Use

Introduction

IMC has partnered with Monday Merch B.V. to launch the “IMC Employee Store,” an exclusive online storefront offering IMC-branded merchandise. This limited-time initiative runs until 15 October 2025, when the store will close and no further orders can be placed.

As part of the program, each eligible employee will receive a one-time €125 gift voucher, valid until 15 October 2025. The voucher may be used only in the IMC Employee Store, and any unused balance will expire automatically when the store closes.

IMC is not the seller of any goods listed in the store. All purchases are made directly between you and Monday Merch B.V., as set out in Part B – Purchase Agreement.


Eligibility

You can use the IMC Employee Store if you have a current employment contract with IMC (permanent or fixed-term), are based in the Amsterdam, London, Zug, or Aarhus offices, started your job on or before 1 September 2025, and are still employed on the day you place your order.

You cannot use the store if you are an intern, contractor, were hired after 1 September 2025, transferred into one of the eligible offices after that date, or are temporarily assigned to any of those offices.


Gift Voucher

Eligible employees will receive a one-time €125 gift voucher via email on 28 August 2025. Vouchers are valid until 15 October 2025. Unused balances expire after this date.

Vouchers are non-transferable, cannot be exchanged for cash, and may only be used for personal purchases in the IMC Employee Store.

If your order exceeds €125 including taxes and shipping, you may pay the difference using a personal payment method.


Platform Access and Use

Access is via your IMC email address (no Okta sign-on). You are responsible for keeping your login credentials secure. IMC may revoke access if these Terms of Use are breached.


Limitation of IMC’s Role

IMC does not handle product manufacturing, order processing, shipping, or returns. All product- and order-related matters are governed by the Monday Merch Purchase Agreement (Part B).


Privacy and Data

Your use of the IMC Employee Store is subject to the Privacy Policy of the IMC Employee Store.


Changes and Termination

IMC may amend or end the Employee Store initiative at any time.


Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Netherlands, without depriving you of mandatory consumer protections in your country of residence. Any disputes are subject to the non-exclusive jurisdiction of the courts of your place of residence or the Netherlands.

Section 2 – Conclusion of Contract

Product listings in the online shop are invitations to order, not binding offers. By clicking “Pay Now,” you make a binding purchase offer.

The contract is concluded when you receive an order confirmation email or see an on-screen confirmation page.


Section 3 – Prices

Prices include statutory VAT and all applicable components. Prices may change without notice; services may be changed or discontinued at any time. No liability for modifications, price changes, or discontinuations.


Section 4 – Payment Terms; Default

Payment methods are those offered at checkout. We may limit available payment methods for risk management.

Credit card payments are charged upon dispatch; PayPal payments are processed upon order completion.

Vouchers issued under the IMC Employee Store program expire on 15 October 2025 and are non-transferable (aligning with Part A). If a voucher does not cover the full order amount, the balance may be paid by another accepted method.

One voucher per order; cash redemption is not possible. Loss, theft, or unauthorized use of vouchers is at the customer’s risk.


Section 5 – Offsetting / Right of Retention

Offsetting is allowed only for legally established or recognized claims.

Right of retention applies only to claims from the same contractual relationship.


Section 6 – Delivery

Delivery is to the address specified in the order. You are responsible for ensuring goods can be received at the delivery location.


Section 7 – Right of Withdrawal

Your statutory withdrawal rights apply as set out in applicable consumer regulations.


Section 8 – Warranty

Liability covers injuries to life, body, or health, and essential contractual obligations.

No guarantee that products or services meet specific expectations.


Section 9 – Liability

Full liability for intent and gross negligence. Limited liability for slight negligence, restricted to foreseeable damages.

No liability for optional third-party tools or linked websites.


Section 10 – Copyright & Usage Rights

All digital content is protected by copyright; non-commercial use only. No removal of legal notices or unauthorized sharing.

Contractual penalty applies for unauthorized use.


Section 11 – General Provisions

We may refuse orders at our discretion. Sales limits per person/household/order may be applied. Errors and inaccuracies may be corrected without notice.


Section 12 – Prohibited Use

Use of the site is prohibited for unlawful purposes, IP infringement, harassment, dissemination of malicious code, or other listed activities. Violation may result in termination of use.


Section 13 – Governing Law and Jurisdiction

This Purchase Agreement is governed by the laws of the Netherlands, without depriving you of mandatory consumer protections in your country of residence. Disputes are subject to the non-exclusive jurisdiction of the courts of your place of residence or the Netherlands.

The following FAQs are provided for convenience only and do not form part of the Terms of Use or the Purchase Agreement. In case of conflict, the Terms take precedence.


When will I receive my gift voucher?
Your one-time €125 gift voucher will be sent via email from IMC on 28 August 2025.

How long is the gift voucher valid?
Gift vouchers must be redeemed by 15 October 2025. Any unused balance will expire after this date and cannot be extended.

Can I give my gift voucher to someone else?
No. Gift vouchers are for personal use only and may not be transferred to family, friends, or other employees.

Can I use my personal credit card to buy additional items from IMC- Employee Store?
Yes. In addition to the one-time gift voucher, you can use your personal credit card to cover any additional costs on the IMC- Employee Store. IMC- Employee Store supports combined payment at checkout.

I’m having trouble logging into the IMC- Employee Store. What should I do?
Log in with your IMC email directly. There is no Okta sign-on. If issues persist, please reach out to merchstore@mondaymerch.com for assistance.

Who should I contact if I have questions about my order?
For general questions, shipping and order-related inquiries, use the Contact field on the site. Monday Merch typically provides responses within 24 hours.

Will new merchandise be released later in the year?
No. This is a one-time merchandise offering for 2025. Additional product releases are not currently planned.

Do I have to pay for shipping or taxes?
The gift voucher is intended to cover the cost of at least one item, including taxes and shipping. If your total order amount exceeds €125, including tax and shipping, you will be responsible for paying the remaining balance using a personal credit card.

How long will it take to receive my items?
Orders may take 4–6 weeks to arrive to your home, depending on product availability. This estimate accounts for the additional production time necessary for made-to-order items. We expect all orders to be delivered no later than end of September; however, this is not a guarantee. For tracking updates, contact merchstore@mondaymerch.com.

Can I return or exchange my items?
All sales are final except where you have a statutory right to return or exchange, such as for defective goods or where mandatory consumer rights apply.

What should I do if my item arrives damaged or is lost in transit?
Damaged or missing items will be replaced by Monday Merch. Please email merchstore@mondaymerch.com within 14 days of receiving your shipment. Requests submitted after 14 days may not be fulfilled.

Can I place a custom order through the Monday Merch Store?
No. Custom or special orders are not available. Only the published catalog of items is offered.

Can I place a bulk order for my team or an event?
No. The Monday Merch store and gift voucher are intended for individual employee use only. For bulk order needs, please reach out to anna.galtsova@imc.com.

What happens if an item is sold out?
Inventory will be reviewed and restocked as needed. However, discontinued items will not be replenished. IMC reserve the right to remove any item at any time.

Are the items sustainably and ethically sourced?
Monday Merch partners with manufacturers committed to responsible sourcing.

How do I choose the correct size?
Apparel is available in sizes S to XL. IMC will also host 2 pop-up fitting events in each office in August and September 2025. There, employees can try on apparel and determine their best fit.
